Special Education and Disability Law

Tulsa Special Education and Disability Lawyer

Many children with special needs experience problems when the public school system fails to provide special services that would help them learn.

Child with a Disability
The term 'child with a disability' means a child with mental retardation, hearing impairments (including deafness), speech or language impairments, visual impairments (including blindness), serious emotional disturbance, orthopedic impairments, autism, traumatic brain injury, other health impairments, or specific learning disabilities; and a child who, by reason thereof needs special education and related services.

Specific Learning Disabilities
The term 'Specific Learning Disability' means a disorder in one or more of the basic psychological processes involved in understanding or in using language, spoken or written, which disorder may manifest itself in the imperfect ability to listen, think, speak, read, write, spell, or do mathematical calculations. Disorders that would be included are conditions such as perceptual disabilities, brain injury, minimal brain dysfunction - Attention Deficit Disorder (ADD) or Attention Deficit Hyperactivity Disorder (ADHD), dyslexia, and developmental aphasia. Disorders not included would be a learning problem that is primarily the result of visual, hearing, or motor disabilities, of mental retardation, of emotional disturbance, or of environmental, cultural, or economic disadvantage.

Know your rights
Parents of a special needs child should know that the law requires school systems to provide certain services. Under the law, your child has the right to a free appropriate public education. They should not be forced to make do with the cookie cutter model of learning, especially if it is not working. Contacting an attorney can be the best way to learn your children's rights and to help them receive the special services that they need to learn and grow. Tulsa, Oklahoma, lawyer Paul E. Swain is knowledgeable about the law and can take action to help.

The law office of Paul E. Swain, PLC, addresses a range of legal concerns related to special education for children with disabilities.
